Now what will happen in the case of Kasab?
When Kasab will be hanged till death?

India is a democratic Nation, and in democracy also if government wishes speedy justice is possible in every case.

Do not forget Still Afzal Guru is alive and his mercy petition is pending with the President of India.
Mohammad Afzal, a convict in the Parliament attack case, had moved a mercy plea in 2006. But the home ministry is yet to forward its recommendation to the President


Now Kasab also got the death punishment and his number is 51, fifty persons are waiting for capital punishment.

Hope there is no corruption involved regarding capital punishment
In India corruption is our religion so everything is possible in India.
We Indians are so clever in corruption you won’t realize if one day any Indian ends up selling the white house to the President of USA.

President K. R. Narayanan did not decide on any Mercy Plea leaving a backlog of 14 mercy petitiotns for President APJ Abdul Kalam.
During his tenure till 2007, Kalam decided only on two petitions-death for rapist Dhananjoy Chatterji and pardon for another.
On his part, he left a huge stockpile of 29 mercy petitions for present President Pratibha Patil. In her tenure till now, Patil has decided on just one plea-commuting the death sentence of one R. Govindswamy in 2009.
According to Article 72 of the Constitution, the President of India is not bound by any time limit in deciding on a mercy petition.

Now Kasab got the Death penalty now what will happen?
when kasab will get actual capital punishment , when government of India will hang him ?

Step - One

The trial book will be made and the case papers, this book will go to the High court then High Court special bench will check the documents and see that the verdict given by the lower, special court is correct, once the High Court is satisfied the Judgment will become valid.
For this the High court may take time of 4 to 6 months.
But today if High court wishes and uses the computers and technology this can be done in a week and they can award and certify that the Death sentence given by lower court is right.

Step - Two

After this if Kasab wants he will file the appeal in High court.
It will take up to 4 to 6 months.
Again as a special case if High court takes special interest and hears this case the appeal can be dismissed in one week.

Step - Three

After High court, Kasab will go to the Supreme Court of India.
Again situation is same if Supreme Court wants can finish this appeal in a week.
Or may take 4 to 5 months.

Step - Four

After this Kasab will file the mercy petition to the President of India, it may take one day or more than five to ten years.

Step - Five

Once President of India rejects his application of Mercy, Kasab will again file the application in the Supreme Court of India for Judicial Review and after that
Supreme Court if keeps the same punishment
Kasab will get the death punishment and he will be hanged till death.

This will take 12 months to 24 months, or more time just like Afzal Guru and others the story of Kasab will stay alive with him.

After 9 months Bombay High Court will give its verdict.

The division bench of Justices Ranjana Desai and R V More, apart from pronouncing the judgement on confirmation of death sentence to Kasab, will also deliver its verdict on Maharashtra government's plea against the acquittal of two Indians accused of aiding in commission of the crime.

Faheem Ansari and Sabauddin Ahmed had been acquitted by the trial court
Both were charged with drawing maps of targets and giving them to Pakistan-based Lashkar-e-Toiba. The LeT handed over these maps to Kasab and nine other terrorists

Calling Kasab's case the "rarest of rare", the two-judge bench comprising justices Ranjana Desai and RV More dismissed an appeal filed by Kasab challenging the death sentence by Special Judge ML Tahaliyani in May 2010.

"This is rarest of rare matter so he should face capital punishment. Kasab and Abu Ismail together killed 56 people," the two-judge division bench comprising justices Ranjana Desai and RV More observed while dismissing an appeal filed by Kasab challenging the death sentence by Special Judge ML Tahaliyani in May 2010.

the High Court also dismissed Maharashtra Government's appeal against acquittal of Fahim Ansari and Sabauddin Ahmed

Today that is 3rd May 3, 2010; every Indian was waiting for the judgment in the trial of 26/11 accused Kasab.

When all this was happening I applied to Right to information department of Heaven and ask them about the terrorist who accompanied Kasab, The right to information department of Heaven, informed me that all the friends of Kasab who got killed in the Mumbai Terror attack are not staying in Heaven, but they all are staying in the Hell.



After knowing this, I applied to Department of Hell to allow me to interview the Dead terrorist, the friends of Kasab who helped him in that war against India,

As I am not a regular reporter, the department asks me did I have the recommendation letter from President Obama or Prime Minister Man Mohan Singh or someone who is has authority.
I informed them give me half an hour and I will get the letter of recommendation.
So I mailed to the Pakistani Prime Minister, President Obama and Our Prime Minister Man Mohan Singh.
I immediately got the reply from the President Obama that he will send me letter of recommendation after asking the Congress, Pakistani Prime Minister denied me permission, and then I saw the mail from the Prime Minister Man Mohan Singh , he informed me that He needs to get the permission from madam as well as other political parties .

After this I knew that I will not get letter of recommendation.

As I was listening news , I saw the message mail from department of Hell , I got worried and opened it , when I read the mail I became happy ,
The mail mentioned that the chief of the Hell Department visited the Blog and when he saw the comments, he got impressed and said no recommendation is better than the comments on the Blog and they gave me permission to interview the dead terrorist friends of Kasab.

The mail said I should be ready within Ten minutes as their GPS system will locate me and just like Star Trek series I will be beamed, teleport transferred to the location of Hell where Dead Terrorist were kept.

I got my notebook, then suddenly I saw the light beaming on me and I got transported to hell.

There one of the guards of Hell informed me that Wait for a minute, then I will be taken to the nine terrorist to interview them.

Then another guard came and he took me to the punishment cell of Terrorist.

Firstly all the terrorist became happy and thought that I am from Pakistan , and came there to shift them into Heaven, but when I told them I am from India , they said sorry and few of them told me they are uneducated and only know Urdu language .

I do not understand Urdu language , but suddenly Ismail Khan , told me he knows English language , and I started my interview with the Ismail Khan .

Sm - Are you all happy after killing the Indians in India?
IK - No one can stay happy in Hell, as punishments are very harsh. We are sorry for killing Indians on the name of Jihad .

Sm - Why did you attack India?
IK - Pakistan is a poor nation, to support the family we accepted the money and also religious leaders told us this is Jihad and we will get Heaven and told us stories of beautiful girls, virgin girls of heaven so we accepted this offer, they tricked us and we all ended up Virgin in the Hell.

Then suddenly one of them started to cry as I ask him why he is crying?
He said all nine terrorist died Virgin and Hell does not have facility of sex for terrorist humans only heaven got the facility of sex.
Now they will stay all virgin forever.

Sm – I told him it’s shocking that you don’t know killing is crime,

IK - yes we knew that but our leaders said in Jihad everything is forgiven, and boys and males who do Jihad get the heaven and beautiful Virgin Females to enjoy in the Heaven.
But reality is that for killing on the name of Jihad is also not allowed.
We learned our lesson that no human has got right to kill other human for any reason including Jihad.

Sm – Please clarify me are you saying for Jihad also killing not allowed?
Ik - Yes it is not permitted, those bastards made us fools and they did not even pay to our family the promised money. I met my mom in Heaven who died without treatment in Pakistan; those bastards did not pay a single penny to our families.

Sm – Who gave you training to do terror attacks?
IK - Laskhar-e-Toiba's (LeT) Maulana Mufti Sayyed and instructer Fadulla trained us all.
On September 15, 2008 Zakiur Rehman selected 10 boys including Kasab and formed five teams for the 26/11 attacks. Kasab was my partner and our team was called as 'team VTS'.

Sm – I again asked them about Does really Heaven has a concept of Virgin girls?
IK – He said that there is no concept as virgin in heaven and the foolish people of earth believe in that, only in Heaven Sex is permitted and allowed, and Hell members are permitted if their performance and behavior is good they are permitted to enjoy sex.
He said all the females are pure always even after sex with multiple male’s
No human has got capacity to make any female impure created by the God.
And he said something created by God, how human can make it impure?

Sm – Do you meet any other Let Members in Hell?
IK - every terrorist, every person who kills on the name of religion and god, ends up in Hell, you will be surprised to know that even Hindus and Christians are also in Hell for the crimes related to the Religion. Everyday they beat us, spanks us with Rods and tell us God has not created religion, how dare you create the religion and follow it to murder the kids of God.

Sm – Do you know about Kasab?
IK – Yes we know about him.

Sm – How do you know about Kasab? What you know about him?
IK – As we did not see him in Hell we all knew that he is alive and my mom who is in heaven, told us Indian police captured Kasab alive and he is in Indian Jail.

Sm – What you think about Kasab Now?
Ik - Kasab is lucky , last 3 years He is enjoying Indian dishes, luxury food , and you Indians are treating him like a king , he is reading books, watching Indian Movies ,
Tell your government hangs him immediately so we will feel happy here in Hell.

Warren Hastings knew that the judicial plan of 1774 was not perfect, and when Warren Hastings again got the chance and He made changes to the judicial plan of 1774, On April 11, 1780 new plan was introduced.


As per the plan of 1780 judicial and executive functions were separated.
Adalats – Function to do civil justice, no revenue work
Provincial Council - No judicial work, only revenue related work, collection and revenue cases.

But with this plan the problem was that, area was vast and adalats were few to administer those large areas, because of this, cases were more, time was limited with the judges and thus arrears piled up in every adalat.
2nd problem was that witnesses have to travel lot to reach the adalats
There was only one Adalat in the whole of Bihar.
Because of this people thought it is better not to file the cases in courts, as filing cases in court meant, delayed justice, physical harassment, waste of time and money.

As per the judicial plan cases up to Rs.100 were referred to the person who stayed near the place of litigant ,but before this it was compulsory to file the case in the Adalat, and 2nd problem was that the person who work as judge has to work as a honorary judge and he did not get any salary . The Zamindar or public officer acted as an honorary judge and they charged money for this and also zamindar got the chance to do corruption as he became the honorary judge.

Warren Hasting was not satisfied with the plan of 1780 he always thought about the improving judicial system in India. The judicial system of East India Company.

On 29th September 1780 Warren Hastings proposed in the Council that chief justice Sir Elijah Impey be requested to accept the charge of the office of the Sadar Diwani Adalat.

Impey accepted this offer.
He remained in Sadar Adalat for a year but he introduced, made lot of reforms in sadar adalat.
Impey Drafted many regulations to reform the adalats.
On November 3, 1780 first reform, regulation was passed to regulate the procedure of the diwani adalats.
As per this rule , the Mofussil judge has to decide the facts , he was allow to take the help of Hindu Pundits or Muslim Mulla if it was necessary to understand the cause or case.
Impey Compiled a civil procedure code for the guidance of the Sadar Adalat and mofussil diwani adalats It was the first code of civil procedure to be prepared in India .
It was promulgated by the Council on July 5, 1781 in the form of a Regulation.
It was the digest of the civil rules
The code consolidated at one place a detailed civil procedure.
The code contained 95 clauses and with it all the previous regulations relating to civil procedure were repealed.
The code of 1781 clearly defined the functions, powers and jurisdiction of Sadar Diwani Adalat.
This code was translated in Persian and Bengali language that time.

In India, Impey was doing great job, but in England People were not happy with the Impey because of following reasons –
Impey was appointed as the Supreme Court judge to monitor the Company affairs in India.
But in India Impey stated to work as a company servant when he accepted to work as the Judge of Sadar Adalat. Accepting this violated the Regulation act.
Because of other job, they believed that Impey would not do the justice with the job of Supreme Court.

Because of all above reasons , on 3rd May 1782 in England House of Commons adopted a resolution requesting the crown, king , to recall Impey to answer the charge of having accepted an office and violating the Regulating act.
After this Impey left India on 3rd December 1782
From the Impey appointment one should learn that what ever post or job may be, the concern person must be studied in that profession.
EG.
Sports minister should be a sports man in his youth, Agriculture Minister should be graduate from the agriculture collage.

Regarding criminal justice system Warren Hasting took following steps.
Machinery was created for the purpose of arresting criminals and bringing them before the fozdari adalat for the trial. This system never existed in India before this.
A new department, office of the Remembrancer was created at Calcutta to keep watch on the functioning of criminal adalats.
The department was to work under the Governor General.
The head of the department was known as Remembrancer of criminal courts.
All criminal courts were required to send periodical reports to this department.
Everything was done as per the Muslim criminal law and Warren Hasting was not happy with many things, and wanted to reform them, he tried his best but company heads did not accept his views.
Because of this in criminal justice system, everyone made money using the corrupt ways.
