Vikas and Vishal Yadav Life Imprisonment of Luxurious Life – Failure of Indian Jail System

Vikas and Vishal Yadav Life Imprisonment of Luxurious Life – Failure of Indian Jail System

Vikas Yadav and Vishal Yadav both are brothers.
Their Father D P Yadav is a very strong and powerful man and he is a former MP.

Vikas Yadav and Vishal Yadav both killed the Nitish Katara.
After that Indian Court found them guilty and gave them life imprisonment as a punishment for murdering Nitish Katara in May 2008.

CNN IBN reported that both the brothers Vikas Yadav and Vishal Yadav
enjoyed 85 medical outings in the last three and half years.

On the name of sickness or other reasons they come out of Jail and enjoy luxury life.

CNN IBN reported that Recently, Vikas Yadav had spent 25 days in
'A' category luxury room of AIIMS for following very serious and life threating diseases for which it is must to get admitted in a Hospital.
1. backache,
2. cough
3. diabetes

The above diseases are so dangerous that I think they should live in a Hospital until the completion of Punishment.

The better option is we need the new law that the criminal should pay One American dollar to the family of person whom they killed and they should be given discharged.

After that if again they kill someone they can again pay 1 USA dollar and they be discharged.

Vikas had stayed in room number 3002 in the new private ward of AIIMS.

Which are the facilities were enjoyed by him in a 'A' category luxury room of AIIMS ?
The A-category luxury rooms in AIIMS have a
1. refrigerator,
2. two air conditioners,
3. a television set a telephone
4. an attached washroom

He stayed their for 25 days and it cost Rs. 45,000 only.
The room in which Vikas stayed cost Rs 1800 per day and the total bill for 25 days.
In 25 days he got the treatment or he underwent was physiotherapy.

Now question is who gave him Physiotherapy?
A hospital nurse or some lady not related with AIIMS.
I do not know about this.

CNN IBN reported that his main requirement, pet scan, costs only Rs 7000 but he did not get that treatment because Tihar did not pay Rs.7000 only.

When CNN IBN started the investigations suddenly without any diagnosis he was discharged from the Hospital.

Between May 2008 and February 2010, Vikas had left jail 66 times on medical grounds, of which 59 visits were to AIIMS.

Vishal had 19 visits to Batra hospital between July 2008 and June 2010, and was admitted twice for two and four months respectively for diseases
1. nausea,
2. breathlessness
3. chest pain

Why this Happens in India The real reason is that our laws are weak and no criminal fears them.

As they know that they will enjoy luxurious life even after getting Punishment whatsoever.

Our Jail system is also failed completely.

We need to reform the failed system.

There's a kind of hush all over the world tonight.
All over the world you can hear the sounds of lovers in love.
You know what I mean.
Just the two of us and nobody else in sight.
There's nobody else and I'm feeling good just holding you tight.

So listen very carefully.
Closer now and you will see what I mean.
It isn't a dream.
The only sound that you will hear
Is when I whisper in your ear
I love you forever and ever.

There's a kind of hush all over the world tonight.

Corporate Taxpayers and Corporate Tax Dodgers, 2008-2010 Report By Citizens for Tax Justice and the Institute on Taxation and Economic Policy

Read Complete Report of
Corporate Taxpayers and Corporate Tax Dodgers, 2008-2010 Report By
Citizens for Tax Justice and the Institute on Taxation and Economic Policy

Citizens for Tax Justice is a nonpartisan research and advocacy group that fights
for tax fairness—at the federal, state and local levels.

Corporations can receive outright rebates by “carrying back” excess tax benefits to earlier years, and thereby getting cash refund from the IRS for taxes paid in the past. In addition, companies sometimes obtain favorable settlements of tax disputes with the IRS covering past years. Companies then recognize tax benefits that they did not disclose in
their prior financial reports to shareholders because they expected that the IRS would not allow them to keep the money.

The Institute on Taxation & Economic Policy has engaged in research on tax policy
since 1980

In the 1980s, CTJ & ITEP collaborated on a series of studies about the taxes paid
or not paid by America’s largest and most profitable corporations. Those eye-opening reports played an important role in educating lawmakers about the tax
issues that were ultimately addressed in the Tax Reform Act of 1986.

This study takes a hard look at the federal income taxes paid or not paid by 280 of
America’s largest and most profitable corporations in 2008, 2009 and 2010. The companies in our report are all from Fortune’s annual list of America’s 500 largest corporations, and all of them were profitable in each of the three years analyzed. Over the three years, the 280 companies in our survey reported total pretax U.S. profits of $1.4 trillion

the federal corporate tax code ostensibly requires big corporations to pay a 35
percent corporate income tax rate, on average, the 280 corporations in our study paid only
about half that amount. And many paid far less, including a number that paid nothing at all.

Twenty-five years ago, President Ronald Reagan was horrified by a similar epidemic of
corporate tax dodging. “I just didn’t realize that things had gotten that far out of line,” Reagan reportedly told his Treasury Secretary. And Reagan solved the problem, by sweeping away corporate tax loopholes with the Tax Reform Act of 1986.
But over time, Reagan’s 1986 decision to get rid of corporate tax subsidies and make our
big corporations pay their fair share has been reversed. Ironically, that reversal has been led in large part by politicians who claim to be Reagan’s disciples

Twenty-five years after the major corporate tax reforms under Ronald Reagan in 1986, we now find the re-emergence of many of the problems that those reforms were designed to address, along with an array of new corporate tax-avoidance techniques.

Over the 2008-2010 period, three-year effective tax rates for the 280 companies ranged from a low of –57.6 percent for Pepco Holdings to a high of 40.8 percent for Coventry Health Care. Here are some startling statistics:

Seventy-eight of the 280 companies paid zero or less in federal income taxes in at least one year from 2008 to 2010. Twenty-five of these companies enjoyed multiple no-tax years, bringing the total number of no-tax years to 108. In the years they paid no income tax, these companies earned $156 billion in pretax U.S. profits. But instead of paying $55 billion in income taxes as the 35 percent corporate tax rate seems to require, these companies generated so many excess tax breaks that they reported negative taxes (often receiving outright tax rebate checks from the U.S. Treasury), totaling $21.8 billion.
These companies’ “negative tax rates” mean that they made more after taxes than before taxes in those no-tax years.

Thirty corporations paid less than nothing in aggregate federal income taxes over the entire 2008-10 period. These companies, whose pretax U.S. profits totaled $160
billion over the three years, in-cluded: Pepco Holdings (–57.6% tax rate), General Electric (–45.3%), DuPont (–3.4%), Verizon (–2.9%), Boeing (–1.8%), Wells Fargo (–1.4%) and Honeywell (–0.7%).

2009 was a particularly banner year for non-payment of taxes. In that year, 49 companies paid zero or less in federal income taxes. These 49 companies, one out of six of the companies in the study, told their shareholders they earned combined U.S. pretax profits in 2009 of $78.6 billion, yet they re-ceived tax rebates totaling $10.8 billion.

In 2008, 22 companies paid no federal income tax, and got $3.3 billion in tax rebates. In 2010, 37 companies paid no income tax, and got $7.8 billion in rebates.

Over the 2008-10 period, our 280 companies earned almost $1.4 trillion in pretax profits in the United States. Had all of those profits been reported to the IRS and taxed at the statutory 35 percent corporate tax rate, then the 280 companies would have paid $473 billion in income taxes over the three years. But instead, the companies as a group paid only about half that amount. The enormous amount they did not pay was due to the hundreds of billions of dollars in tax subsidies that they enjoyed.

Tax subsidies for the 280 com-panies over the three years totaled a staggering $222.7 billion ($61.4 billion in 2008, $76.2 billion in 2009 and $85.1 billion in 2010). These amounts are the difference between what the companies would have paid if their tax
bills equaled 35 percent of their profits and what they actually paid.

More than half of the total tax-subsidy dollars over the three years —
$114.8 billion — went to just 25 companies, each with more than $1.9
billion in tax subsidies.

# Wells Fargo topped the list of corporate tax-subsidy recipients, with
$18 billion in tax subsidies over the three years.

# Other top tax subsidy recipients included AT&T ($14.5 billion), Verizon
($12.3 billion), General Electric ($8.4 billion), IBM ($8.3 billion), Exxon Mobil
($4.1 billion), and Boeing ($3.6 billion).

Industrial machinery companies enjoyed the lowest effective tax rate over the three years,
paying a negative tax rate of –13.5 percent of their profits in federal income taxes. This
industry’s taxes declined sharply over the three years, falling to –36.4 percent of profits in 2010. These results were largely driven by a long-time champion tax avoider, General Electric, but GE was not alone. Four of the seven companies in this industry paid effective tax rates of less than 10 percent during the 2008-10 period.

# Other low-tax industries, paying less than half the statutory 35 percent tax rate over the entire 2008-10 period, included: Information Technology Services (2.5%), Utilities (3.7%), Telecom-munications (8.2%), Chemicals (15.2%), Financial (15.5%), Oil, Gas & Pipelines (15.7%), Trans-portation (16.4%), and Aerospace & Defense (17.0%).
# Only two industries, Retail & Wholesale Trade and Health Care, paid an effective tax rate of 30 percent or more over the full three-year period

“Top Defense Contractors” is not exactly an industry, but it is a group that paid notably low tax rates.

We examined the 134 companies in our survey that had significant pretax foreign profits (i.e.,equal to at least 10 percent of their total worldwide pretax profits), and compared the 2008-10

U.S. and foreign effective tax rates they paid. Here is what we found:
# Two-thirds of these U.S. companies paid higher foreign taxes on their foreign profits than they paid in U.S. tax on their U.S. profits.

# Overall, the effective foreign tax rate on the 134 companies was 6.1 percentage points higher than their U.S. effective tax rate — almost a third higher

Boeing. Recently, it was awarded a $35 billion contract to build new airborne tankers for the Air Force. That seems all well and good. After all, the contract was subject to competitive bidding, and Boeing won. And for its $35 billion, the Pentagon will get the planes it says it needs. But on top of that lucrative contract, Boeing gets a bonus. Over the past three years, Boeing reported $9.7 billion in pretax U.S. profits. But instead of paying the 35 percent corporate tax rate on those profits, Boeing received $3.5 billion in tax subsidies. As a result, it paid no federal income tax at all over those three years. The truth is that Boeing doesn’t need subsidies to build planes. It just needs someone who wants to buy them, such as occurred with the tanker deal.

In short important points of report

Corporations are lobbying for lower corporate rates and an exemption for profits they shift offshore. McIntyre, however, says “Our study provides proof that too many corporations are already being coddled by our tax system.” Findings in the report include:

The average effective tax rate for all 280 companies in the study over the three year
period was 18.5 percent; for the period 2009-2010 it was 17.3 percent, less than half the
statutory rate of 35 percent.

78 of the companies enjoyed at least one year in which their federal income tax was zero
or less.

30 companies enjoyed a negative income tax rate over the entire three year period on
their combined pre-tax profits of $160 billion.

Total tax subsidies given to all 280 profitable corporations amounted to $222.7 billion
from 2008-2010.

Wells Fargo tops the list of 280 U.S. corporations receiving the most in tax subsidies,
getting nearly $18 billion in tax breaks from the U.S. treasury in the last three years.

Pepco Holdings had the lowest effective tax rate of all the companies in the study, at
negative 57.6 percent over the three year period

Some companies within sectors fare worse than others. For example, the report finds that
FedEx paid a 0.9 percent tax rate over the three year period while its competitor, UPS,
paid a 24.1 percent rate.

While retailers and wholesalers in the study generally pay average effective tax rates of
about 30 percent, Amazon.com paid a rate of only 7.9 percent on its $1.8 billion in profits
from 2008-2010.

Financial services received the largest share (16.8 percent) of all federal tax subsidies
over the last three years. More than half of federal corporate tax subsidies for companies
in the study went to four industries: financial services, utilities, telecommunications, and
oil, gas & pipelines.

The top ten defense contractors saw their combined tax rate decline from 19.3 percent in
2008 to a mere 10.6 percent rate in 2010.

U.S. corporations with significant (ten percent or more of their total worldwide profits)
foreign profits paid tax rates to foreign countries that were almost a third higher than they
paid to the IRS on their domestic profits.

2G Scam - DMK MP Kanimozhi and 7 others denied bail Trial To Start From November 11

2G Scam - DMK MP Kanimozhi and 7 others denied bail Trial To Start From November 11

Person can do a murder suddenly but corruption needs a planning and good management.

Special CBI judge O P Saini rejected the bail application of - DMK MP Kanimozhi and 7 other accused in the 2G spectrum allotment corruption case.

All the accused will continue to stay in Tihar Jail and trial will begin from November 11.

Following are the names of 8 accused persons whose bail application were denied by the learned and honorable Judge O P Saini.

1. Kanimozhi

2. Swan Telecom promoter Shahid Usman Bal

3. former communications minister A. Raja's ex-private secretary R.K. Chandolia

4. Kalaignar TV chief Sharad Kumar

5. directors of Kusegaon Fruits & Vegetables Pvt Limited Asif Balwa

6. Rajiv B. Agarwal - director of Kusegaon Fruits & Vegetables Pvt Limited

7. Bollywood producer Karim Morani

8. former telecom secretary Siddhartha Behura

All the above accused were present in the Court when their Bail plea was denied.

Special public prosecutor U.U. Lalit had told the court that the bail application of Shahid Balwa and Chandolia should be denied bail as maximum punishment for the specific charges leveled against them was seven years.

Why the Judge denied the Bail?
Honorable and Learned Judge O P Saini gave following 5 reasons for not giving the bail.

1. accused may tamper with evidence

2. providing a safe and secure environment for witnesses to testify truthfully is possible only by keeping accused in custody

3. There was no discrimination faced by kanimozhi as a woman, hence bail on gender grounds was not possible

4. Accused are charged with criminal breach of public trust leading to a life term if found guilty

5. The Judge also highlighted that offence was not simple offence was planned by accused persons to use public money for the personal benefit

The decision of the judge is excellent and perfect and we need a law which will forbid the bail once the charges are framed.
This will help to speed up the trial of the case.

Normally what happens is that once the bail is given and everyone forgets the case and the story of date after date and date and date starts.

Regarding Corruption cases what ever may the prescribed punishment we need a reform which will clearly say that

Once the Charges are framed by the Court in a Corruption case there will be no Bail on any ground if you are sick go to Government Hospital but you as a accused in a corruption case you do not have a right to get a Bail.

Corruption is nothing but cheating whole country

Demand Corruption equals to Death Punishment or 1000 Years of Jail without Bail or Pardon

Anna Hazare Complete Audit Report of IOA - for the period April 1st-September 30, 2011

During the past year the whole world has seen the strength of our democracy. The nation came together to fight graft and ask for a tough anti corruption mechanism.

We sincerely acknowledge all our countrymen and women across the world who participated in the movement in many ways. We feel pride and pleasure in narrating some facts of this movement.

During the past six months hundreds of thousands of people participated in various Jan Lokpal programmes across the country with their physical presence, thousands contributed financially too. 27,505 were number of contributors recorded by us. This number is actually higher since some contributions were offered by one individual after collecting from a neighborhood, village or group.

Ramlila Maidaan that witnessed the outpouring of patriotism with long queues of volunteers and donors. 25,023 people individually or as a group contributed at the Ramlila Maidaan counters.
It has been heart warming to note that 23,138 contributions were of Rs.1,000 or less. It has been humbling and moving to note that people with very limited resources contributed with sums like Rs. 1, – 2 – 5 of their hard earned money. This means more to us than millions stashed away illegally.
More than 400 contributions were of Rs. 10,000 or more.
The maximum contribution was of Rs. 25 lakh. The next was of Rs. 4 lakh and one of Rs. 3 lakh.
At Ramlila grounds the total cash contributions stood at Rs. 98,98,106. The total cheque contributions here stand at Rs.15,18,330.

While these figures are of no special significance in the accounting practice, they are special for us. This demonstrates the extent and depth of the Jan Lokpal movement. We salute you all, and the Indian in everyone who made this possible.

China launched an unmanned spacecraft Shenzhou-8 for first space docking successfully

Tuesday –

Commander-in-chief of China’s manned space programme Chang
Wanquan announced that in the early hours of Tuesday China successfully launched an unmanned spacecraft Shenzhou-8 for first space docking successfully from Jiuquan Satellite Launch Center in northwest Gobi desert.

Wu Ping, spokesperson for China’s manned space programme, said that
Chinese and German scientists will conduct 17 life science space experiments on the Chinese spacecraft Shenzhou-8.

On September 29 china launched Tiangong-1, or the “Heavenly Palace” that was put into space successfully

Now spacecraft Shenzhou-8 is moving towards Tiangong-1, or the “Heavenly Palace
for rendezvous and in next 2 days it will happen.
The docking of the Shenzhou-8 will take place at a height of 343 km above the Earth’s surface. It will return to the Earth after two docking tryouts.

If it becomes successful it will open the way for china to operate a permanent space station around 2020.

Currently only USA and Russia got this capacity and now China may become third country who will enjoy such power.

The experimental docking is part of China's preparation for building its first space station by 2020, where astronauts can live for several months, as they do on NASA's International Space Station or the former Russian Mir.

If it is a success, China will launch another two space craft next year to conduct more docking experiments.

At least one will be manned, and two female astronauts are among those being trained for the mission, Xinhua said. If they are chosen, they will be the first women China has sent into space.

Majority advertisements were placed in the Delhi editions of newspapers.

BJP spokesperson Prakash Javadekar told to media that Today there are hundreds of advertisements on Indiraji," We don't see anything wrong (with that) - but there is just one Information and Broadcasting ministry advertisement remembering Sardar Patel. These tributes have to be rational,"

Pawan Bansal, Parliamentary Affairs Minister said that each ministry made its own call. "We do not issue instructions to Ministries on how much money to spend on advertisements.

Same parties say Mayawati is doing wrong when she spends on statue.

As an Indian citizen we must understand all the political business houses are same with only one aim.

We need a law which will ban such wastage of government money.
It’s your money, it’s my money.

We do not have money, our Indian farmers are committing suicides, and we do not have money so Government is planning to cancel the subsidy on cooking gas.

But government does not pass the laws which will stop the wastage of money.

If you love her so much please spend money from your own party pockets not from the pockets of others.
