SC Historical Judgment Appointment of Justice RA Mehta as the Gujarat Lokayukta by Governor is Legal

on August 25, 2011 Gujarat Governor Kamla Beniwal had appointed Retired Justice R A Mehta on the post of Lokayukta.

The post was kept vacant for 8 years giving one or another reason as again in India it is not compulsory to appoint a Lokayukta.

What is the duty of Lokayukta = To find corruption done by the Politicians and government officers.

Police department and CBI work under government so normally they do not dare to go against the ruler there appointment and promotion giver.

When Governor appointed a Lokayukta, Gujarat government did not like it and they approach to the High Court saying Governor bypassed the state government

After that, Gujarat Government filed an appeal against High Court Order supporting the appointment of Lokayukta in Gujarat state in the   Supreme Court.

Not appointing a Lokayukta in Gujarat by Modi government was big mistake but no politician made it an election issue, as no Politician likes a Lokayukta.

Today once again saving the Indian citizens Supreme Court of India ruled that that the appointment of retired judge RA Mehta as the state's Lokayukta or ombudsman is valid.

Reform Suggested -

If Chief Minister of a state does not appoint an Lokayukta within period of six  months , governor should get the right to appoint a Lokayukta without consulting Chief Minister of a state.
